Terms of Service

Important: Monte is a simulation and education tool. It is not investment, tax, or financial advice, and Monte is not a registered investment adviser, broker-dealer, or fiduciary. Results are mathematical projections based on assumptions you provide — not predictions of actual market outcomes.

1. Agreement

These Terms of Service ("Terms") govern your use of the Monte iOS application and this website (together, the "Service"). By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. By using the Service, you represent that you meet this requirement.

3. License

Subject to these Terms, we grant you a personal, non-transferable, non-exclusive, revocable license to install and use the app on devices you own or control, in accordance with the Apple Standard EULA, which is incorporated by reference.

4. Acceptable use

You agree not to:

Reverse engineer, decompile, or attempt to extract source code from the app, except where this restriction is prohibited by law.
Use the Service to violate any law or third-party rights.
Interfere with, abuse, or overload our servers or third-party services the app relies on (including our Cloudflare market-data proxy).
Scrape, redistribute, or resell market data obtained through the app.
Use the Service to provide regulated investment advice to third parties.

5. Not financial advice

Monte presents probabilistic projections based on Monte Carlo simulation and inputs you provide. These projections are inherently uncertain. Past performance and modeled returns do not guarantee future results. The Service does not account for every factor relevant to your personal financial situation, including but not limited to taxes specific to your jurisdiction, estate planning, insurance, or sequence-of-returns events outside the modeled distribution.

Always consult a qualified financial professional before making investment decisions. You are solely responsible for any decisions you make based on output from the Service.

6. Market data

Market data displayed in the app is provided by third-party data providers (currently Financial Modeling Prep) and is believed to be accurate but is not guaranteed. Data may be delayed, incomplete, or contain errors. We do not warrant the accuracy, timeliness, or completeness of any market data.

7. Subscriptions and payments

Monte offers Free, Pro, and Max tiers. Pro and Max are sold as auto-renewing subscriptions through Apple's In-App Purchase system.

Billing. Subscriptions automatically renew at the end of each period unless cancelled at least 24 hours before the period ends.
Cancellation. You can cancel anytime under Settings → [your name] → Subscriptions on your iOS device. Cancellation takes effect at the end of the current billing period.
Refunds. All refunds are handled by Apple under their policy. Request via reportaproblem.apple.com.
Free trial. If a free trial is offered, your subscription begins automatically when the trial ends unless you cancel before then.
Price changes. We may change prices for new billing cycles. You will be notified before any price change takes effect.

8. Intellectual property

The Service, including the app, this website, the Monte name, logo, and all related content, is owned by us and protected by copyright, trademark, and other laws. Nothing in these Terms transfers ownership of any of it to you.

Content you create using the Service (your portfolios, goals, saved scenarios) remains yours.

9. Privacy

Your use of the Service is also governed by our Privacy Policy.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ACCURATE, OR ERROR-FREE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR INVESTMENT LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50).

12. Indemnification

You agree to indemnify and hold us harmless from any claim arising out of your misuse of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms. You may stop using the Service at any time by uninstalling the app.

14. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Disputes will be resolved in the state or federal courts located in California, and you consent to that venue.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you inside the app or update the "Last updated" date above. Continued use of the Service after a change means you accept the revised Terms.
